POLICY•
SUBDIVISION REGULATIONS POLICY
Sketch Plan Approval - A concept plan will not be required
where there is already an approved Sketch Plan. This would
apply to all Sketch Plans approved since February 1, 1988
(sketch plans are valid for one year). After February 1, any
modification of an existing Sketch Plan would require Concept
Plan submittal. However, the preliminary plat would be
subject to the revised specifications.

Preliminary Plats approved by the Planning Board prior to
February 1 will not be subject to the new provisions. This
category only includes the two preliminary plats presented to
the Board of Commissioners on February 6.
Pending Preliminary Plats
(No Planning Board Approval)
All preliminary plats which have not received Planning Board
approval by February 1 will be subject to the new plat
specifications. One preliminary plat application was
received on January 18, and another is expected by January
23. Both of these projects have received sketch plan
approval.
Final Plats (Major Subdivision)
All Final Plats submitted after February 1 which received
Preliminary Plan approval prior to February 1 would continue
to be processed under the current procedure and would be
approved by the Planning Board.
The Planning Board recommended that the proposed policy be
approved, and that all affected applicants be notified.
RECOMMENDATION: The Administration recommends approval of
the proposed policy and the notification of
applicants.

FEBRUARY 6, 1989
The Orange Gounty Board of Commissioners met in regular session on Monday,
February 6, 1989 at 7:30 in the courtroom of the Old Courthouse, Hillsborough, North
Carolina.

Chair Carey moved item F2 to GO and stated that G7 and G8 would be considered
first under G - Items for Decision. He deleted from the Appointments abstract those
appointments listed for the Human Relations Commission.
County Manager John Link changed the last data listed in the Airport Calendar,
item F-1 from June 20 to June 27.
Commissioner Hartwell asked that the County Manager contact the wildlife officer
and the sheriff to discuss what needs to be done to enforce those hunting laws that
are on the books and more specifically the law that states you may not hunt from the
right-of-way of the road. Also, public relations is also needed to inform the hunters
what is expected of them in Orange County.
Commissioner Willhoit announced that the North Carolina. Low Level Radioactive
Waste Manageanent Authority will hold a public hearing in Hillsborough vas March 14 at
7:00 p.m.

Mr. Roy McAdoo and Ms. Ann Hadley spoke regarding the Efland sewer system and
requested an extension of 30-45 days before being required to pay the minimum monthly
fee.
After an extended discussion, it was decided that because of the financial
arrangements for this project that an extension could not be granted. The County
Manager is to follow up with JOCCA and supporting their bid for additional funds.
Mary Sechrist of the White Cross community and Marilyn Mooney of the Staneybrook
Subdivision exprossed dissatisfaction about the green box situation. Zhe County
Manager is to meet with Mooney and inform her of what the County is doing to
consolidate the sites and the problems the County is encountering in doing so.

to approve the minutes for the budget work sessions held in June, 1988 as circulated.

Director of Housing and Community Development Tara Fikes explained the Interim
Assistance Grant Program and requested authorization to submit a letter of interest to
NRCD. This program is designed to increase the availability of housing for low and
moderate income persons. Specifically, the program can provide CDBG construction loan
financing at an interest rate substantially lower than market rates to a developer
building housing for low and moderate income persons. The anticipated interest rate is
two (2) percent. Grant awards are limited to $750,000 for 36 month projects and
$4,000,000 for 18 month projects.
Runyon Colie Woods of the Colie Development Compairy was available to answer
questions. He stressed that the required letter of credit would be provided by the
Colie Development Company so that the County will not bear any financial burden if the
anticipated funds from the project are not realized. This application and the
County's assistance in this application will lower the cost of the average house in
this subdivision about $6,000. He asked that the cost of administering this program
not bs added to the loan total. This would further lo~uar the cost of each house by
$600. John Link stated that the requirements on the County in administering this
program would ba extensive and the County should be reimbursed for these
administrative costs.
Motion was Wade by Commissioner Hartwell, seconded by Co~issionsr Willhoit to
approve submission of a Letter of interest to NRCD and authorize the Chair to sign on
behalf of the Board and to establish February 21, 1989 as the public hearing date to
receive citizen cooment regarding the application.

The Commissioners approved by eonsenaus the date of September 14, 1989 for a
Joint Planning Area Public Hearing. The proposed date for March was not approved,

Motion was made by Commissioner Hartwell, seconded by Commissioner Marshall to
approve the items listed in the advertisement for the joint public hearing scheduled
for February 27, 1989.
VOTE: UNANIMOUS.

Motion was made by Commissioner Halkiotis, seconded by Commissioner Hartwell
to authorial legal action against Buckner Steel for on-going violations of the Orange
County Zoning Ordinance.

PURPOSE: To consider a policy for processing of subdivision
applications submitted prior to the February 1, 1989
effective date for revised application and approval
procedures.
sACRdROU11D: On January 3, 1989, the Board of County Commissioners
approved a major amendment to the Subdivision
Regulations involving plat specifications and approval
procedures. The change will go into effect on
February 1, 1989. Under the new provisions, major
subdivisions will require Concept Plan approval by the
Planning Board prior to submittal of a Preliminary
Plat, and the Final Plat will be approved
administratively. Under the existing provisions, a
sketch plan is approved administratively, and the
Final Plat is approved by the Planning Board.
To minimize and avoid any disruption to projects which
are in process and have received somC fos':a of
approval, the follov-inq policy was proposed for
consideration by the Planning Board at its January 23,
1989 meeting.

forwarded to the Economic Development Task Force
for consideration. Seconded by Yuhasz.

c. Policy Consideration - Subdivision Regulations
Section III Application/Approval Procedures
Presentation by Mary Scearbo.
On January 3, 1989, the Sward of County
Commissioners approved a major amendment to
the Subdivision Regulations involving plat
specifications and approval procedures. The
change will go into effect on February 1,
1989. Under the new provisions, major
subdivisions will require Concept Plan
approval by the Planning Board prior to
submittal of a Preliminary Plat and the Final
Plat will be approved administratively. Under
the existing provisions, a sketch plan is
approved administratively and the Final Plat
is approved by the Planning Board.
The Planning Department recommends that a
policy be established regarding the handling
of those projects which are already in
• progress. It is the desire of the Planning
Department to minimize and avoid any
disruption to those projects which have
already received some form of approval.
The Planning Department recommends that those
Sketch Plans, Prelf~ninary Plans and Final
Plats in various stages of the approval
process be handled in the following manner:
Sketch Plan Approval
A Concept Plan will not be required where

since February 1, 1988 (sketch plena are valid

modification of an existing Skstch Plan would
requite Concept Plan submittal. However, the

on the January 23 agenda (Laws Estate, Fox Run
Annex). It is anticipated that the Board of
Commissioners decision will be made on
February 6.

All grelitainary plats which have not received
Planning Board approval by February 1 will be
subject to the new plat specifications. One
preliminary plat application was received on
January 18 and another is expected by January
23. Both of these projects have received
sketch plan approval.
Final Blots (Major Subdivisions)
All Final Plats submitted after February 1
which received Preliminary Plan approval prior
to February 1 would continue to be processed
under the current procedure and would be
approved by the Planning Hoard.
The Planning Staff recommends approval of the
proposed policy.
Best suggested that Staff notify nny
applicants who are is the Sketch Plan stage of
the new procedures that they must adhere to
for the preliminary .plat. Scearbo responded
that could be done by-letter. ---
MOTION: Hest moved approval as recommended by the
Planning Staff. Seconded by Eddlemaa.
Yuhasz questioned the logic in requiring that
final plans come back to the Planning-Board
for approval.. Scearbo responded that when the
new system is started there will be a new
format so that it will be very clear at the
time of prelinary plat approval everything
that needs to be done to submit a final plat
but also sverything that needs to be done to
record a final plat. In some cases, there are
some conditions that are required for
recordation of the final plat that are not
necessarily included in the preliminary plat
stage.

Jacobs indicated concern with not seeing a ~
concept plan of those projects already in the
sketch plan phase. Scearbo responded that
Staff felt that up to this point the applicant
had done everything required of him. If an
applicant is required to submit a concept plan
as well, it would create an additional step
for the applicant unnecessarily.
