BOARD OF COMMISSIONERS °''~
June 7, 1971
The Board oP County Commissioners of Orange County met in regular session
at 10;00 o~clock A. M. on Monday, June 7, 1971, in the Commissioners Room at the
Courtheuae in Hillsborough, North Carolina.

Members Present: Chairman Harvey D. Bennett, and Commissioners William C.
Req, Henrq 5, Walker, Ira A. Ward and C. Norman Walker.
Members Absent: None -
In the abaenas of the Clerk to the Beard the minutes of the previous
meatinga were read by' the County Administrator and approved by the $oard.
Commissioner William C, Ray advised the $oard that Lacy Gibson, District
Manager of the Fermata Home Administration, had died and that he felt some type
of acknowledgement should be made to Mrs. Gibson since Mr. Gibson,-had worked
for many years with County Government. The Clerk was instructed to extend to
Mrs. Gibson the condolence of the Board relative to her loss.
Chairman Sennett recognized Coolidge Porterfield, Executive Director oP the
Orange County Housing Authority. Mr. Porterfield stated that the Joint Orang~-
Chatham Community Action Agenaq~s budget had been cut for the current fiscal gear
and there was a possibility that the Housing Authority would have its offioe
staff funded by the Federal Housing Authority of the Communitq Action Agency,
therefore, they plan to cut the housing pregram from its current budget and this
meant his position with the Community Action Agencq would expire on August 31, 1971.
Chairman Bennett recognized Tom Ward, Director oP the Social Services ,
Department.
Upon motion of Commissioner Henry S. Walker, aeaonded by Commissioner
Norman Walker, Chairman Sennett was authorized to alga the following $lind Aid

Upon motion of Commissioner William C. Ray, it was moved and adopted, that
Commissioner Norman Walker be appointed Por a three year term as a member of the
County Board of Social 3arviaes. Said appointment to be effective June 1, 1971.

Chairman Bennett read a letter Prom the Chapel Hill City School Unit. Said
letter rea..uested the Soard to support the proposed State-Sponsored $200,000,000
bond issue for public school construction. Discussion ensued relative to said
reaueat.
Upon motion of Commissioner Ira A. Ward, seconded by Commissioner Henry S.
Walker, it was moved that the Board oP County Commissioners endorse the proposed
legislation that would provide for an election of a state sponsored $200,000,000
bond issue for public school construction. Chairman Bennett called for a vote ',
on the motion. Commisaionara Ira A. Ward, Henry S. Walker and Norman Walker noted:

Chairman Bennett recognized C. W. Davis, Homer Davie and Mitchell Lloyd, Sr.
Mr. C. W. Davie was apokeaman for the group and presented a road petition signed
by reaidenta of old N. C. Highway 86 South requesting that improvements be made
to said road. Discussion ensued.
Upvn motion of Commissioner William C. Ray, seconded by Commissioner Norman
Walker, it was moved and adopted, that the Clerk to the Soard propane a letter
addressed to the State Highway Commissioner endorsing the requested improvements
to Old Highway #8b South.
Norman Long, County Zoning Officer, requested that the Soard set a time, date
and place for a public hearing on zoning matters. Tha public hearing wsa aaheduled
for Tuesday, July 13, 1971, at S P. M. in the Courtroom at the Courthouse in
Hillsborough.
Diacusaion ensued on the re-zoning request of W. C. Byrd. Mr. Byrd had
requested that a tract of land be re-zoned Prom residential to rural commercial.
It was noted that the tract of land did not contain the maximum number oP footage
required for rural aommeraisl use.
Upon motion of Commissioner Tra A. Ward, aeoonded by Commissioner Henry
Walker, it wee moved and unanimously adopted, that the request of W. .C. Byrd
to re-zone a treat of land from residential to rural commercial be denied on
the basis that said treat did not meat the meatimum number of feetage required
for rural commercial use.
Chairman Bennett then asked the Board if it was ready to consider the
proposed Ordinanoe entitled "AN ORDINANCE REG-LATING EXPOSING TO VIEW THE HUMAN
kEMALE BODY". The Soard members agreed that L. M. Cheshire, County Attorney _.
should proceed with the second reading of the proposed Ordinance.
Commissioner Henry S. Walker asked the County Attorney who would defend the
Ordinance if the legality of said Ordinance wsa questioned by a suit. Mr. Cheshire
replied that it would be the reaponaibility of the County to defend the adopted
Ordinance.
Chairman Beanett called Por a vote on the motion. Commissioners William C.
Ray, Henry S. Walker sad Tra A. Ward voted aye. Commissioner Norman Walker noted
nay. Chairman Bennett then declared the motion passed and the Ordinance duly

Chairman Bennett recognized Ebert Pierce, County Agricultural Extension
Chairman. Mr. Pierce reported that all the Nutrition Aida had been hired and that
it was too early to determine what aucaesa the program would en3oy; however, he
was very pleased at being able to institute the program. Mr. Pierce advised the
Board that ha had been assigned by the ~cteneion Service to attend summer school
for three weeks beginning on June 21, 1971.
Discussion ensued concerning the $5,000 Homestead Exemption Bill. The Board
re-affirmed its present position of opposing said bill.
Discussion ensued relative to House Bill #83l} which would allow alasaiPication
of farm land for ad valorem tax purposes.
Upon motion of Commissioner Ira A. Ward, it wsa moved and aeoonded, that the
Orange County Board of Commiasionera oppose House Bill #8311..
Discussion ensued and Commissioner William C. Hay stated that unless some
tax relief was given tc the farmer then the maJarity of them would be forced to
leave the Farm. Chairman Bennett called for a vote on the motion. Commissioners
Norman Walker, Henry S. Walker and Ira A. Ward voted aye. Commissioner William C.
Ray voted nay.

Chairman Bennett presented the Research Triangle Regional Planning
Commisaion~s report on the location of I-40. Ne action was takes on this report.
The County Attorney reported the conversation which he had had with
Senator Gordon Allen relative to House Bill ',663. Senator Allen had requested
that the Board submit to him, by way of letter, their positioa concerning said

Upon motion oP Commissioner Norman Walker, seconded by Commissioner Henry
S. Walker, the following Resolution was adopted:
THAT WHEREAS, the Commissioners have no objection to the
students who are residents of Orange County and who desire to
attend the schools of Alamanae County attending said schools, the
Board Sa unalterably opposed to enlarging the Aiamance County School
Administrative Unit so as to include any portion of Orange County
under any circumstances:
THEREFORE, BE TT RESOLVED that the Board of Commissioners of
Orange County does hereby express its unalterable opposition to
House Bili 663.
Chairman Bennett recognized the Tax Supervisor who presented the following

5. Walker, it was moved and adopted, that releaaea number 521 through 526 be
approved.
The Tax Supervisor requested that a release oP interest for Ernest Mazzara
in the amount of $10.00 covering the 1969-1970 tax bills be made.
Upon motion of Commissioner Ira A. Ward, seconded by Commissioner William
C. Ray, the Tea Supervisor was authorized to reimburse Mr. Mazzara in the amount
oP $10.00. '
Chairman Sennett presented a letter from the $oard of Education. Said
letter requested that the Board endorse the School Boards request to the State
Highway Commission that SR 1315, known as the EPland-Cheeks School Road, be
paved.
IIpon motion of Cemm3.saiener W3.lliam C. Ray, seconded by Cosmaiasioner
Norman Walker, it was moved and adopted, that the Board approve the paving of the
Efland-Cheeks School road.
The County Administrator advised the $oard that in preparing the 1970-1971
budget that he had shown the FIysoneeahee Library appropriation request as
19,930.00 when it should have been $20,630.D0. Mr. Gattia recommended that an
additional $700.00 be made available #x'am the k~aergency I~znd to cover the
diPPerenae created between the two appropriation Figures.
Upon motion oP Commissioner Ira A. Ward, seconded by Commissioner William
C. Ray, it was moved and adopted, that the County Administrator be authorized to
take $700.00 Prom the Emergency Fluid and apply same to the 1970-1971
Hyconeechee Library budget.

The Ccunty Attorney advised the Board that certain impediments oP title could
be lodged against the heirs of Robert and Zuvenia Bynum because of a Old Age
Assistance Lifts filed against Golden B. Holman, therefore, in order to clear
the title it was necessary for a release deed releasing any possible claim
from aotiae of lien Piled in the ofPiae of the Clerk oP Superior Court of Orange
County on August 2, 19b6, against Qolden B. Holman.
IIpon motion of Commissioner Ira A. Ward, seconded by Commissioner Henrq S.
Walker, it was moved and adopted, that Chairman Bennett be authorized to sign a -",
release deed from Orange County to Nettie Bynum Shaw on lot !} oP the property of
Robert and Luvenia Sgnum heirs.

There being no further business to c^me before the Board the meeting was
adjourned to meet again on Thursday, June 10, 1971, at 5:30 P.M. in the Commissioners
Room at the Courthouse in Hi7.laborough and on Monday, June 28, 1971, at 10:00
A. M, in the basement of the Orange Savings & Loan Building in Chapel Hill and
again on Tuesday, June 29, 1971, at 9x00 P.M. in the Commissioners Room at the
Courthouse in Hillsborough, North Carolina.

June 10, 1971
The Board of County Commissioners of Orange County met in adjourned session
at 8:30 P.M, on Thurdday, Tune 10, 1971. in the Commissioners Room of the
Courthouse in Hillsborough, North Carolina.
Members Present: Chairman Harvey D. Bennett, and Commiasionara William C.
Ray, Henry S. Walker, Ira A. Ward and C. Norman Walker.
Members Absent: None
Thin session was held For the purpose of discussing the possibility oP
completing the water line along East Center Street with members of the Mebane
Town Board of Aldermen and the Manager of the Town of Mebane.
A representative of the General Electric Corporation was also present. He
stated that General Elactric~a concern in the matter was to assure that an
alternate source oP water to their pleat might be obtained. Chairman Bennett
stated that the Covnty intended to complete the water line when there is enough
demand for the water, thus justifying the County~s expenditure for said project.
The County Administrator advised the Beard that the North Central Piedmont
Resources Conservation Ac Development Agency planned to proceed with the
installation oP the sediment atruatur0s at Lake Orange.
